A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without lawful basis.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The case originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. After his repatriation to the United States to face alien smuggling allegations, he was detained in federal custody.
In her decision, the court pointed out that the authorities lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
The legal proceedings center on conflicting assertions. While the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently denies this allegation.
He has also pleaded not guilty to the conspiracy counts, which are part of a separate trial in Tennessee.
The court, who was hearing his petition to deportation in a federal court, determined that he must now adhere to the terms of his bond from jail in Tennessee. This order shifts his supervision to the Tennessee court.
